1. Agreement to Terms

By accessing or using the CrowdFun platform, mobile application, or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. The Service is operated by CrowdFun LLC ("CrowdFun," "we," "us," or "our").

2. Description of Service

CrowdFun is a community-driven marketplace platform that connects local entertainers with parents seeking kids' activities. Entertainers list pop-up entertainment events at local parks and playgrounds, and parents purchase spots for their families. Events require a minimum number of participants before they are confirmed. Once confirmed, the entertainer delivers the service and receives payment through the platform.

3. Eligibility

You must be at least 18 years old to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as needed. CrowdFun reserves the right to suspend or terminate accounts that violate these Terms.

5. Payments and Refunds

Payments for event spots are processed through our third-party payment provider. When you reserve a spot at an event, your payment is held until the event reaches its minimum participant threshold and is confirmed. If an event does not reach its minimum and is not confirmed, your payment will be refunded in full. Refund policies for confirmed events that are cancelled are subject to the specific event's cancellation terms as displayed at the time of purchase.

6. Entertainer Obligations

Entertainers who join the platform agree to provide services as described in their event listings. Entertainers are independent contractors and are not employees of CrowdFun. All entertainers are subject to a vetting process before being approved on the platform. CrowdFun reserves the right to remove any entertainer from the platform at its sole discretion.

7. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Provide false or misleading information
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to other user accounts
• Use the Service to harass, abuse, or harm others

8. Intellectual Property

All content, trademarks, logos, and intellectual property displayed on the Service are the property of CrowdFun LLC or its licensors. You may not reproduce, distribute, or create derivative works from any content on the Service without prior written consent.

9. Limitation of Liability

To the fullest extent permitted by law, CrowdFun shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. CrowdFun acts as a marketplace platform and is not responsible for the quality, safety, or legality of events listed by entertainers.

10. Indemnification

You agree to indemnify and hold harmless CrowdFun LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.

11. Modifications to Terms

CrowdFun reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

12. Termination

CrowdFun may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
